  • informing the accused of the relevant substantive and procedural rules;
  • expressing an opinion about the suspect (e.g. highlighting his positive qualities to the authorities or in court);
  • the exercise of all procedural rights which, by their very nature, are also vested in the accused (presence, questioning, comment, motion, remedy);
  • continuous monitoring of specific rights of the defence;
  • investigating the facts (even by conducting your own investigation);
  • seeking to end criminal proceedings or to reach an agreement with the authorities (court).1

If the appointment of a defender of rights is only made at a later stage of the proceedings, the appointment of a mandatory defender of rights need not be automatically withdrawn if the appointed defender cannot guarantee that he or she will be able to complete the case. Indeed, in such cases, a “substitute appointed defender” may be involved in the proceedings in addition to the mandated defender.2
